Can I apply EAD renewal now?

I'm on H1b 6th year and H1b will expire on Jan 2008. My lawyer suggests not to extend H1b but use EAD. My first EAD expire date is 12/08/2007, but I did not use for work. Now questions.

1> considering the huge fee jump :eek: next month, can I renew my EAD before 7/31/2007? my lawer said I can only file 90 days before the previous EAD expires. Is this true? I saw some posts saying they sent EAD renewal 5 months ahead to avoid the long waiting and possible gap.
2> many folks say e-file I765 / I131 is fast and convenient. After e-file, which address I should send the supporting docs? If I also e-file my spouse EAD/AP, are we supposed to mail the support docs in seperate pakages per case?

You can file EAD up to 6 mo in advance. Check USCIS official site.

Address will be printed on the first page after you complete electronic filing.
If I also e-file my spouse EAD/AP, are we supposed to mail the support docs in seperate pakages per case?
I mailed in seperate packages for all 3 of us.

It is better to apply for H1 renewal since:
H1 is for 3 years while EAD requires annual renewal
If your AOS hits some problems, you can do H1 transfer and work for some one else. You only have to apply for EAD 4 months in advance, evene then, you might loose on 1 month.

EAD enables you to hold part-time jobs in addition to your primary job.
Annual EAD+AP renwal will cost you ~$750 if you do it your self, more if your lawyer does it

-----> You can apply EAD renewal 6 months in advance. Sometimes, EAD renewal could trigger the I-485 approval if your PD is current. You can get lucky. So, apply now for EAD renewal.

Thank moldermarv,armie & hopeofgc. I think I'll apply EAD renewal and AP before 7/31 anyway. Probably also think about H1b extension later on. Thanks again. Hope all of us can get through this endless waiting soon.

Hi:

I'm submitting/filing EAD Renewal by myself.

Does any one know where to mail the application.

I filed my I-485 at Nebraska Service Center.
