Can I apply 7th year extension

My labor is approved.

I-140 is denied becuase of degree not match with labor certification, so I-485 also denied. And filed appeal for I-140 with evidence of degree match with labor certification.

My h1 is expeiring in Dec 04, but I arrived in US first in May 99. And then I was out of country for almost 2 months for vacations.

Can my employer file for 7th year extension?

Can my employer file for additional period till July 05 (May + 2 month vacation)?

Assuming 365 days have passed since filing of your labor, you can apply based on the pending appeal.

Your's truely was in the similar boat ...
