I-140 for a person who left the company got approved. When that person called the lawyer and asked for a copy of it he was told that he can\'t give it as our company decided to use that approved I-140 for another person in the company. Is that allowed? I thought it is a named based approval and can\'t be used by another person.

Well....I-140 is filed by the employer(Petitioner) for the employee(Beneficiary). The company is justified in not giving out the 1-140 approval to the ex-employee.

The ex-employee has no use of the I-140 anyway. I am not sure if the company can use it for some other employer or not. I vaguely remember reading somewhere that they can use it.

That\'s CRAP! The I-140 is given to the individual for a particular set of required criteria for the job. The I-140 is granted after the individual has met the necessary critieria. And if it\'s after 180 days of you filing I-485, then they should give you the I-140. Contact another lawyer and get some proper advice.

This is not the right place to ask such critical questions.
