My lawyer mentioned that if the job requirement is BE(Mechanical Engineering) and MS(Software Engineering) with 0 years experience, this it can trigger audit for the perm labor certification. Did anybody have this type of requirement? Please post some replies.

Thanks

I believe one or both of you are confused with the hybrid job requirement. The element that would trigger the audit would be question #H15, which asks if the job is a combination of positions. I've never heard of an application that requires a specific bachelor's AND master's degree. Normally, the "or related degree" should be included, otherwise the application would be considered to be "tailored," which could lead to a denial for fraud at the I-140 level. The requirement should be a master's degree in the field mentioned or a related degree.

Thanks st4rguitar for posting. The job does not have the requirement of Masters. But it does require engineering background with software. I have bachelors in Mechanical engineering and masters in software engineering. Thats why i got hired. How can the job decription be framed so that it can be fall under EB2 category. Please post some suggestions.

Thanks for reading my post.

Requires a "master's degree with 1 year of experience" with the alterative requirement as a "Bachelor's degree with 5 years of progressive experience in lieu of required education & experience, or any suitable combination of education, training, or experience."
