Can he get the GC for his wife ?

I am writing this about my friend:

He came to US on GC in 1995, sponsored by his mother, and went to India and got married. Their affair was a long one and had kid before marriage. His parents were against marriage; only her parents were OK. Now he is almost done with his wife's GC process and it is expected any time. He got some kind of notice.

Now he has a problem; his elder kid's age and marriage dates do not match. Kid is older than their marriage date. Is this a problem at the consulate? How can he prove to the Consulate that the kid is born before their marriage? What kinds of documents required at the consulate ?


Any suggestions ?
 
ask him to get a birth certificate notarized after marriage. that is only solution. saying there is no birth noted in the records and get a non availability certificate then change the data of birth.

Kid born before marriage does not nullify a legal marriage. Period. You do, however, need a birth certificate to prove his/her birth parents, and date of birth (whatever that maybe).

will not have a problem. BTW tell him it is still better for him to consult a lawyer....;)
