Can H4 Dependent get Visa revalidated in an Indian consulate without H1 visa holder

I am on H4 and my husband on H1, Our Visa expired in last june 04, we have got the visa extension till 2006 june, I am planning on a visit to India, if i go alone to india.. can i get the visa stamped in Chennai or any other Indian Consulate without my husband accompaniying me ...or should my husband also come with me since he holds H1 ? pls reply me... it has been 2 years that we went to india and now have this problem... any suggestions would be highly appreciated. thanks!

Dont worry about this issue. If you have the approved h4 extension notice from INS for you, then you should be fine. But you need your husband's approved h1 notice (please take the original i-797 document if possible along with new I-94) along with the regular documentation. If you have all this documentation, then you should be fine. But if you still think something may happen.. i suggest you to contact an attorney for an advice just to make sure. But i am sure that you should be fine to go alone as long as you have all the necessary documents. Let me know if you need any help with the documentation. Please submit the Notarized copies for all your husband's documents unless a original is required like employment support letter, etc.. Hope this clarifies your question.

Your original I-797, I-94, your husband's employer's letter, marriage certificates are a must (keep marriage photos also handy, they asked my wife once). The logic is, anything to prove that you are who you say you are. They may even ask for your birth certificate. Depends on the interviewer and his/her mood.

Of course self-confidence is the best ally, and you must not appear hesitant or nervous, you must exude confidence. If you answer a question or 2 confidently and clearly, then you may not be asked for additional documentation.

My wife got his H4 without H1 in my passport jsut before just a few days ago. My passport still reflects visa from my old company which is going to expire in few days.So dont worry and have faith in God. You will get there.

She will not have original I-94. Mainly You need your husbands documents. Your H4 extension help you show that you were in status.

You husband's Payslips, W2 , employement letter , H1 approval notice, copy of his I-94 are the basic things you have to take
