Can Employer A's approved labor and 140 be used by Employer B to get a 3 yr H1b extension (I'm on 6th yr now), if both Labor and I-140 by the new employer cannot be completed before H1 expires (have only 9 months in 6th year) ?
I am currently in my 6th yr of my H1 - expiring early December 2007.
PD : Oct 29th 2006
PERM Labor : Approved by mid December 2006
I-140 : Filed on Feb 7th 2007
Receipt number receive date: Feb 8th 2007
Question : Now I am changing my employer, whose attorney tells that the previous employer's approved Labor and I-140(trusting it will be approved well before early December 2007) can be used to apply for 3 yr extn with this new employer, if both Labor and I-140 by this new employer cannot be completed before H1 expiry.
Is that true ? What I know is Labor and I-140 is valid for only to the employer who petitioned it and cannot he used by other employer for any reason including applying H1 extn. Please share your experiences and observations.
