Can Employer revoke an approved 140?

Hi,

My 140 /485 ND is 02/18/2004 & my 140 is approved. Can my Employer revoke it?
If he can what will be the status of my 485?

I have heard that within 3 months of approval from one website(but not sure if anyone has experienced it), an employer can still revoke it.

Alternative: File another Labor or buy a pre approved labor.

Your employer cannot revoke an approved 140 if you have completed 180 days from filing 485. Even if they revoke it would not affect your 485 (looks for AC21 threads elsewhere in the forum)

Yes I agree with that. If employer revoke you may get an Notice of intent to denial. You need to have same or similar job so that you can use AC-21. sending AC-21 letter prior to revocation might be better idea.

Well here is the case - I have completed 180 days with my 485 filing and am still with the same employer. As things are going a little rocky, I wanted to know to know if there is a law which will prevent him from pulling out the approved 140 - esp. if I continue with him.

In case I have to leave and if he revokes it - will i still get an intent to deny notice for my 485? I will use AC21.

Lastly, as 180 days have passed for my 485 and its been over 3 mths for my 140 approval - still is he in position to revoke it? Will it be of any use to him?

I guess you are safe now, 3 months after 140 approval and 6 months after filing 485.

Yeah, an employer can use an approved 140 of yours to another employee if he can get better $$$$$$$$$$$$

That would not be possible. The new application will be denied.

A quick question - When we say 180 days is it business days or straight 6mths?
I did concurrent filing in Feb /2004 .
