I plan to quit my employer and have a substantial saving in my 401(K). Before quitting i'd like to know if my employer can claim the money from the 401(K) plan account as damages, especially since i plan to work directly for the client as an independent contractor. What this means to the employer is a violation of a possible non-compete clause in my employment agreement which i'd signed more than 4 years ago.
Any advise / suggestions are greatly appreciated.
