Hi Folks:

Can the beneficiary file Form G-639 (FOIA) to request his approved I-140 and underlying Labor certification details?

As per my understanding LC and I-140 are actually owned by employer and BCIS may not disclose to the benefiaciary?
Does FOIA overrides this rule?

What sort of problems it causes in processing AOS applications and other pending application at BCIS for the associated beneficiary if he files using FOIA ?

Please post your FOIA experiences and provide your valuable advise....

Thanks in advance...

kvpt_mm,
Based on the comments from this forum members beneficiary can use FOIA to get copy of I-140 approval and the underlying petition.

Let's see what we hear from others.

Thanks for the reply Edison

I read your post on 5th Ausgust, no body seems to have any experience with FOIA.

As you said we will wait and see for people's response.. I am sure somebody will ring a bell.

I think you can only request information under FOIA, not force a government department to take any action.
