Can Atternoy send reply of RFE in applicants absence

I was wondering can atternoy reply to USCIS thereply of RFE even if primary aplicant is ouut of US. Since rfe i sonly send to atternoy so I giess it should be possible! On eof my colleague aske dme this question. any experienc or input is allreciated.

It shouldn't matter where the primary applicant is, you should keep in mind that if the attorney needs any documents from you, he/she has to wait for the primary applicant to return or make alternate arrangements to provide the documents to the attorney.

Not with our attorney. She sent it out, providing us a copy of her cover letter and info provided. It was before I signed up to www.immigration.gov case status search service, and didn't even know we had an RFE. Good luck!
 
You filed a G28 appointing the attorney to speak on your behalf in all matters relating to your immigration case.

True, but if he/she are out of the country and the attorney needs documentation from them, G28 can't do much. <Little Room>
 
I think the attorney can reply without the applicant beeing directly involved.

Of course, the logistics usually will require your cooperation, but legally the attorney can make a statement on your behalf based on the G28.

(i.e. you don't have to sign your reply to an RFE)
