Can anyone start a business when you are on H1 ?

In the current market I have seen lot of H1 people started doing businesses like Dollar stores, SAM. Some of them started business on at home with their wife name(Visa Status H4). They are using 800 numbers for their services. How far they are legal to do this type of Business ?

As far as I know, if someone on a H visa starts a business, s/he is not allowed to work for that business unless s/he have a work permit from that company.
