Hi, I just got my FP done. I am under EB2, LC. It seems like many people here were asked by INS
for those documents. Please briefly explain what are \'amendment\', \'Redo\' and \'RFE\'. In what situation
INS may need those documents. Will everyone under EB2/LC get notices from INS for those documents? Thanks a lot.

New Guy.

I140 \'amendment\' and \'redo\' sort of refer to the same thing - having to file an another I140. For example, when a company name changes or is acquired by another company in a "successor-in-interest" i.e. new company acquires all assets and liabilities of the old company (some people consider this as an \'amendment\'). Or when the employee switches company and wants to substitute a new I140 for the old one before the I485 is adjudicated (some people consider this as a \'redo\'). However, I\'ve also seen people use the terms \'amendment\' and \'redo\' interchangeably.

RFE is a Request for Further Evidence. If the INS discover the company has changed names (e.g. between the I140 and I485) they may issue an RFE asking for an I140 amendment. RFEs can be issued for any documents however e.g. they might issue an RFE asking for recent pay stubs, tax returns and/or a letter of employment from your sponsoring employer (proving the job offer is still open).

Not everyone has to file an amended I140. Not everyone receives an RFE. It just depends on the individual case.
