Hi there,

I have an urgent question that I need a second opinion on. I am currently a GC holder for 9 yr, and had an possession of control substance charge (class a misdeameanor) over 8 yrs ago. This was back in college, and yes it was extremely stupid and dumb. Wish i can turn back the time. That was the only arrest I have ever had. I currently reside in Chicago, but the case was back in NYC. I currently have a job, home, and a fiance who is us citizen, not to mention my whole life in front of me. My GC expires next year...

My question is this, I have read that control substance is a temporary bar from naturalization for 5 yrs. However, when i was reading the INA site, it appear that this offense is deportable and not eligible for naturalization. Which is correct? (does anyone know a case that had successfully naturalized with a drug conviction?)

I have spoken to lawyers that told me mix answer... some say its not a big deal and have had experiences with naturalizing GC holders that had felony convictions. Some told me that its not possible to naturalize under my conviction. Gosh... i am SOO confused!! Please help~ I am truly grateful for your input!!

As far as I know, in US, offenses can be grouped into three general categories. The most serious are felonies, the penalty for which can include a term in a state prison. Next are misdemeanors, the penalty for which can include up to one year in a county jail. The least serious are infractions (mostly traffic offenses). If GC holders who had felony convictions can have naturalization then you can easily have it. If not, then ask experience lawyers to know how to get naturalize under your conviction.

By the way, you haven't deported yet, that meant you are good ;) I hope and pray for you to get naturalization and became USC.

Both are correct. It depends on the substance and the amount and the length of the sentence. Get a lawyer who can analyze the details of your case (including the number of grams of the substance) to determine if it is a deportable offense. Apparently you didn't give the lawyers the full details of your case, including the court paperwork.
