h4--h1

hi,

i have appliedfor new h1 ,it is in process,right now i am on h4 and h4 is going to expire in few days,do i need to apply for new h4 or can i wait for some time for h1 approval...

If I have apply new h4 and if i get h1 ,h4 simultaniously what i have to do,what is my current status..(i want to be in h1)?

The last action taken by USCIS will dictate what your status will be.
If you apply for H4 now and it is approved after your H1 is approved, you'll end up being in H4.

I am not able to decide,what should i do now,with out applying h4 can i wait for h1,is it legal?
