is it legal or illegal to take a second job? EB3, 140 approal, 485 not available.

Thnak you for your help

Are you H1B, probably ? If so, as far as I know that is illegal to work for other employer other than the one who sponsored H1B for you.

If you've got an EAD (what probably is not your case) then you can work for others part-time. That's what I have been doing.

If your part time job is in a fast food restaurant or gardening, you don't have to worry.... tons of illegals are already doing it. :D

marlon2006,

Are you working full-time for the employer who sponsered your H1 and working part-time on EAD for another employer at the same time? If so, what will happen to your H1 Status? explain.

You can get another H1B approval from the new employer and then work simultaneously on two jobs with two H1B's.

Yup... that may eventually give yourself a GC without a sponsor or the hassle :D

I on was on H1B and EAD was on my possession as well. Then the day I took my part-time job, I went to my full-time job and presented my EAD, filled new I-9 form listing EAD card.

If you work on EAD, your H1B status is considered invalid at that point. I cannot tell you what I relief was the day I could seek part-time work. I can't imagine the freedom I would have by getting GC.

Is this really possible ? In my opinion you can only work for one H1B sponsoring employers. You can have as many as H1B visas as you like but you can only work for one employer at any given time. If this is true then people will make lots of money by doing 3-4 jobs from home !

Purethoughts,

It is possible by concurrent H1B filing. I think it can be either part time or full time. Search on concurrent filing in this forum or murthy's website for more details.
