Can AC-21 applicable to the following scenarios?

Case A): Concurrently filed 140/485 with 180+ days; 140 pending (not approved yet).
Can I join a new company with a similar position
with the AC-21?

Case B): Concurrently filed 140/485 with 180+ days; 140 pending (not approved yet). Can the employer revoke the 140?

Pls advise -- I talked to two lawyers with these two questions, but it sounds they do not have the same answer.
 
1. Possible but really risky, AC21 does not really cover 140 cases. But it might slip through if the petitioner does not revoke the underlying 140. Which leads us to your second question.

2. YES! Until the petition is approved it belongs to the company.

Please check the forum entitled "THE COMPLAINT" where Rajiv Khanna has filed a lawsuit against INS and is fighting actively for 140's to be approved within 180 days by right.
