Can a person have B1 and H1-B at same time ?

You will have both the VISAs stamped(Active) in your passport. US consulate will not cancel your B1 if you go for H1B stamping.

But, the POE will only admit you in 1 status, so upon entry, you need to tell the CBP officer, which status you are claiming, B1, or H1.

My wife has H4 visa stamp valid till Dec 2006 and H1 visa stamp valid till Oct 2007. Mumbai consulate issued her H1 visa and did not cancel existing H4 visa. So I think you can have multiple valid visa stamps at the same time in your passport. At POE she was admitted as H1 and white I-94 is valid till Oct 2007.

One thing to keep in mind is if you hvae multiple visa valid on your passport then show the visa page which you intend to enter at POE. My wife just handed the passport at POE and initially officer issued H4 but fortunately she noticed the issue and asked officer to correct it to H1.
 
Hi All,

What if someone has H4 & B1 (that is stamped in Canada) instead of changing status within US? On entry if B1 is stamped what will happen to the H4, will it get cancelled?

Hi All,

I hold a valid H1 filed from a company in US, but I did not move to US because of some personal reasons. Now my current employer in India wants to send me on an B1. Does it mean that, if I apply for a fresh B1 my H1 will be cancelled?
 
Hi,

Please see this situations and let me know if anything would be problem.

1) Go out of US while on H4. Probably POExit will take the I-94 issued based on H4.

2) Come back on B1. Will POEntry will issue new I-94(B1)?

3) Go out of US while on B1. Will POExit will take the I-94(B1)?

4) Enter on H4. POEntry will give I-94(H4).

Last year one of the companies in US applied for my H1 visa.It got approved but is yet to be stamped.
This year my company in India requires me to go abroad on a B1 visa.Currently i have two visa recepits one for H1 and one for B1.Both are not stamped yet.
I am planning to avail my H1 after my B1 visit for the present company.Is it possible to get the B1 stamped now and the H1 stamped later.I hope my H1 will not be cancelled if i get B1 stamped first.can you please suggest something for this.
