Can a F1 via student apply for a Green Card

Hi,

I have a sister who is a US Citizen, and I am an F1 student, wondering if it would be possible to apply for green card through my sister, and how?

Thank you

Seth

Of course she can petition you. However, you should know that there is currently a 12+ year wait for the priority date to become current in the siblings category. So after she files the petition you will need to wait 12+ years before you can actually proceed on the process of applying for a green card. By that time you will very likely not be an F1 student anymore, or in the U.S. at all. So whether you are F1 now or not is kind of irrelevant.

Thank you for your answer, I have an additional question

Will having a current sibling category greencard petition affect my eligibility for H1 visa sponsor by an employer in any way?

Thanks

Seth
