I am on a H1-B visa and have an approved I-140. I had listed my spouse as a dependant on the I-140 application. She is now on a F1 visa and is studying in the US. She is planning to travel abroad and in order to get back she would have to get the F1 visa stamped. Does her mention on my I-140 application display intent to immigrate ? There is a question on the F1 visa app asking whether any immigrant visa petition was filed ? What are the other options if her F1 cannot be stamped or would be rejected?
