Hi

I would like to know if a child born in India can be added later on in the 485 stage. That is the the EAD and FP have been done already but the approval has not yet come. at this stage can the child's name be added to the GC process.

I think it is possible

Drawing an analogy, I know of a friend whose FP, EAD, AP were done/recvd and then he got married and filed his wife's 485. So, if you can add one dependent then it should be possible to add another one (the child in this case).

Discuss with a good lawyer, I am almost sure that should be possible (the only thing would be how close is the principal applicant to get approved, if it is pretty close then lawyers might say no). No harm in discussing with a lawyer, right?

Any newborn who's born after filing 485 can be added as dependent to primary 485 applicant and you will need all his/her credentials to file a new 485 for the child. But if the child was born earlier and you have not declared in your G28 form of filing of 485 you will have lots of problems to yourself and his/her application , Cause that will be fraud of facts you were to state in G28 form at 485 filing stage. Second if you have mentioned that child nameand details in G28 then also you can file for his 485.
