I know a guy who just got maried an US citizen 19 yr girl. He told me his newly married US citizen wife had even filled for his GC. My question is can she apply cause she's not even 21 & as far I know one has to be atleast 21 yrs old to apply for USCIS benefits.
Members, could you please clarify this? By the way that guy even received his finger print letter for coming Thursday. Is it really possible ??
Thanks.
Atique.

A person needs to be 21 to file for their Parents, siblings only.
Spouses could even be a minor 15 years old, obviously the 15 year old minor will need parental consent to get married. At 19 she is a adult.

Well, as far I know for USCIS 18 yrs not considered adult. They want applicants 21 for seeking benefits.
Atique.

Your info is incorrect, 18 is considered to be a adult everywhere, for USCIS petition filing it is JUST filing for Parents that a person has to be 21 years old. That is why their petition has been accepted and FP appointments have been scheduled.

To sponsor a sibling or parent, you must be 21 or older.

To sponsor a spouse or child, I don't think there is a minimum age cutoff.

18 is not adult everywhere in the world. It is 19, 20, or 21 in some countries.

I think that's why USCIS set the cutoff at 21 for children as derivatives or immediate relatives. Rather than have a different age based on country (which gets even more complicated when somebody with citizenship A is living in country B), they just set it at 21 to be uniform for everybody.

I think we are in a US immigration forum, so when i said "Everywhere" I am just talking about US.

My husband is 19 and he filed for me so as stated before it is possible unless the person is filing for relatives then they have to be 21

wait for for the interview,the USCIS only consider 21years to be an adult,you must be 21 years or older before you will be able to seek immigration benefit,please mate always read the instruction in the form before you fill or apply. ready the instruction on the I130 you will find it there.these are little reason why AOS remaining pending for years;)

From the I-130 instructions:
1.If you are a U.S. citizen you must file a separate Form I-130 for each eligible relative. You may file a Form I-130 for:
A. Your husband or wife;
B. Your unmarried child under age 21;
C. Your unmarried son or daughter age 21 or older;
D. Your married son or daughter of any age;
E. Your brother(s) or sister(s) (you must be age 21 or older);
F. Your mother or father (you must be age 21 or older).

2. If you are a lawful permanent resident of United States, you may file this form for:
A. Your husband or wife;
B. Your unmarried child under age 21;
C. Your unmarried son or daughter age 21 or older.

1A, does not state age restriction for Spouses.

Form I-864 (Affidavit of Support) states this:
A sponsor completes and signs Form I-864. A sponsor isrequired to be at least 18 years old and domiciled in theUnited States, or its territories or possessions.

18+ is considered adult by USCIS. But the 21yrs for adjust of status for relatives (non-spousal) is as Jack mentioned earlier.
