can 7th yr ext be filed before 365 days ?

The rule of 365 days applies to when 7th year extension can be filed or to when 7th year employment can start ?

If H-1B is valid until beginning of Jan 2006 and labor was filed in November 2004, then can 7th year extension be filed before November 2005 as long as 7th year period is Jan 2006 - Jan 2007 ?

what will happen if the 6 years of H1 is passed but you have H1 till next year? Will that be out of status or you can adjut it while filing for extension?

- I got my first H1 in May 1999 and since then I have joined 3 other companies and transferred H1 succefully.

- I filed for Labor Certification (RIR) in 2002. Email request was replied from Philly Backlog center stating that "The case status is incomplete."

- When the last H1 was applied I got valid date till June 06. I have a I-94 which is stamped till June 06.

Attorney is saying I should have filed the 7th year extension in May 05? So he is saying I am out of status. Is he right?
