Can 485 be filed if 140 approved (if proposed rule is passed)

I had read about the propsed rule of being able to file 485 even if visa numbers not available. immediately i thot that wud be great because then atleast the spouses can get ead and 140 portability thing can be used. but then i read carefully the proposed text-it says that ppl who have pending 140's will be able to file for 485 with ofcourse extra fees, but what about ppl who got labor cleared recently and filed for 140 alone(since 485 cudn't be filed) and who have gotten 140 approved also. Now even if this new proposed rule comes into affect,will i be able to atleast file 485 or not?????
anybody any thots?
