Calling all Guru's.Should i apply under EB2 or EB3?

Gurus I need your Advise.

I have a EB3 Petition pending in VT which is not being Processesd as the Original Labor Certification is lost.The Time frame within which a Certified copy will be available to VSC is not clear and hence my case is in a Limbo.

Fortunately, I have another Company applying for me.
Given that its only now that the Labor is going to be applied for i want to know what category should i opt for for EB2 or EB3 ? The Position and my qulifications are such that it can be fled in either of these categories.

We all know that EB3's are being processed faster for now but with EB3's Date's Retrogessing to January 2002 and also the USCIS plan for Concurrent Processing of I-140 and I-485, would it be advisable to go for EB2?

Hi Bodhal,

Good to notice your reply.The new filing is not on Substitution.

We both have April '04 ND's.

After your I-140 approval are there any new developments(Finger printing Notice or any new LUD's)?

What are your qualifications and experience?
Recently in a case known to me VSC rejected the EB2 case. He has 4 year engineering and MBA. They said that Masters in India requires three-year degree for admisssion and is not equivalent Masters in US, which requires a four-year degree.

It is better if you have five years of experience to apply in EB2.
 
You need to also look at the company ability to pay the prefered wages. The prefered wages of EB2 are higher. If your current annual salary is in par with EB2 wages or the company has good financial standing then you can go with EB2.

Same old status, No FP Notice yet.
