California labor processing

Hi,

I have applied for my labor ceritification, and yet it is to be certified by the california DOL and federal DOL. I have heard, in due course(I dont know when), the government is having an idea or discussion that processing the labor stage will be done within one month , that is like, premium processing. I need to know, whether this is true or false? I really appreciate, if someone replies about this.

Also, I need to know, whether , having a US born child, will help in getting the GC easier for the parents?

I have browsed the website and got some info about PERM.

When PERM is implemented, will it be of any use to us to speed up the process of labor certification? what are the advantage and the disadvantage?

Also, i have a simple question for discussion sake.

For example, i have applied my labor on 25 march 03. If I am clearing SESA on, may be , 1 march 04. Then they are transferring the papers to DOL and the receipt date , may be , 15 march 04. If this is a the situation, I need to know, at what date will DOL take for processing. Is it 25 March 03, the receipt date of SESA OR the receipt date of DOL, ie.15 March 04? Hope i am making the situation clear.

PERM regulation is slated to be out at the end of this year (one site suggested it has slipped to next year), and will be implemented after 120 days (I believe that will be initial rollout in few places) -- the dates are still fuzzy and keep moving around.

Advantages are faster decision on the application, but the policies are too restricitive so meeting the standards could be difficult.


15 march 04 will be the priority date for you w.r.t DOL processing.
The concept of using 15 march 03 is for the 3rd stage where you are allowed to apply for that stage only when they reach the priority date (processing will still take a while after that). This was useful previously when there were too many application in the queue, but these days priority dates are current, so you can apply for 3rd stage whenever you are ready (provided priority dates remain current when you are ready)
