California Labor Certificate

Hi there,

My labor application was originally received by DOL (Department of
Labor) around early June 2002. According to my lawyer, current
processing times in California are September 2002.

I am wondering why my case has been in processing for three months.
My lawyer was trying to inquire with DOL about my case repetitively
but still has not go an answer.

Anybody in the similiar situation or know what is going on?

By the way, my green card application falls into the category of EB3
(slow track).

& also your PD is June 2002 or RD is June 2002 ? What does AVM says ?

Here are the original words from my lawyer:
June 5, 2002: "On 06/05/2002, we have received notice that your labor certification application was forwarded to the U.S. Department of Labor on 5/29/02"

Jan 30, 2003: "The DOL in CA is currently processing cases received in January 2002. As your case was received by the DOL in June 2002, based on these processing times, it appears that it may be another 6 months before we can move forward to the next step."

Aug 12, 2003: 'Processing times in California for cases at the region are September 2002"

I don't know what AVM means?

I would like to know if it means anything negative since my case have supposedly been in process for over 3 months"?

For NON-RIR cases, the latest status on Immigration site is for 6/02, not september, your case might be in the works currently

your case was received by the DOL in June 2002,
 
Labor applications go to SESA before going to DOL.When SESA approves the application then it goes to DOL.

I don't remeber exactly, maybe sometime in the second half of 2001.

My lawyer also recently told me that my case was filed EB3
rather than EB2. The case was still filed as an RIR.

She also mentioned that some cases at the California region are
being held while they wait for guidance from headquarters as to how to proceed with RIR cases that they feel have US worker availability. A written inquiry was submitted on 9/4/03.

I am afraid my case won't go though.
