I received three different sets of information in the last week or so, and I am having a tough time putting the threads together. None of the sources are any more credible than the other. Can someone interpret it for me please? Thanks in advance.

1. We received fingerprint notices on July 2 (my priority date became current on July 1) and we went for the prints on July 8. Calls to FBI verified that the prints were returned to USCIS within 24 hours. Our lawyer contacted the VSC after a few days and found out that the case is with an adj officer - but she was also informed that apparently our fingerprint notices were returned undelivered! (imagine - while I have the notices with me - and we did the fingerprints already!)

2. My wife went for an interim EAD at Boston CIS and was informed that our case is going through background checks. He was busy shooing away all the people at the counter - so he didn't bother to explain what sorts of checks, ie, NC or whatever. Just FYI, our NC was once cleared in Nov 2003 ... as our RD is May 2003. I don't know if they would do it again.

3. I called VSC today to verify the address and fingerprint issue. I got the line in about 5 minutes and spoke with an IIO. The lady was quite nice and she was surprised to find about the delivery problem etc (depends on what type of access she has though). But she went 'inside' the file and verified that they indeed have our fingerprint results (the LUD doesn't reflect that though).

She also said that the file 'barely hit the department' today so I should wait 30-60 days to hear something. Now this part I don't understand. According to the attorney, it was already with the adj officer! And then the fingerprint was done in July 8 as well. So why should the file 'barely hit the department' today? Or does the file move back and forth between fingerprint, background check, etc departments and came back to the adj officer? Can someone see a link here? Thanks.

When I asked about the status of the background checks - she said if she tries to pull up that information - my file will be out of the queue and be delayed again. Is that really the case or just hogwash?
