BS not in the field LC requires, but MS is

Hello.

I am ready to file I-140 now, my LC requires
BS in computer science or related field and 6month experience. The problem is that my BS is not
in computer science or related, but my Master degree is.


Question:
1. Do I have to file my BS degree? From the instructions of I-140, EB3 requires to
file BS degree.
2. Will it be fine if only include MS degree when filing EB3 I-140, not BS degree? Or file both
degrees, even if BS is not in the field as required.

Any suggestions will be greatly appreciated!!

Unfortunately, my diploma date was after I was hired.

I met all the MS requirement on 07/1999. But I didn't request my diploma until 05/2000.

I was hired on 09/1999.

My diploma was issued on 05/2000.

My labor was filed on 11/2000.

I can ask the University to issue a verification
letter saying that I met all the MS requirements
before I was hired, but what else should I do to
make this case have better chance?

Did INS really check the diploma date against
hiring date, or against Labor process starting date?
 
You can ask the university to issue a letter syaing that you had met all the requirements for the MS degree as of 7/99. I think the letter should help in convincing the INS that you were technically done and just delayed graduation.

Yes, they check the date of diploma as of the date you were hired.
