BS +4yrs = EB2????

I graduated in Oct 2001 with a Bachelors degree. I have been working since June 2002 on a H-1b. I used to work for a Fortune 100 firm and sicne they didnt wanted to puruse GC, I moved on and currently working for a niche botique consulting firm with less than 10 employees. Hopefully it might increase in next couple of months. The company has good financials - 1mill + in 2004, quater mill in 2005.

I am wondering with 4 years of exp how can I apply for EB2 category?

Since the firm has less than 10 emp would there be any problem getting EB2 approved?

I have really nice offers from other big firms and only thing stopping me from joining them is that they will only apply GC after 12-18 months after I join the firm, which I cannot do. Can I change firms after I get my EB2 and 140 approved and maintain my PD?

BS+4=EB3 not EB2

You can move out after 6 months of pending I-485. B4 that if your I-140 is approved, you move to a new company and your old I-140 is cancelled (bcoz you don't work there anymore), then you can't use your PD. If they don't cancel I-140 after you leave, you can use the old PD.

How about work exp during BS ?

Should the 5 years of experience be after BS for EB2 ?
Can we include 1.5 years of exp during BS for EB2 ?

Hi PV4466,
This is new info for me that PD for labor from one company can be used for GC through another company if the previous company do not cancel I140.

Are you sure this rule exist?
