my case details are below. i am waiting for my i-140 approval for the past 1 and half years. strange situation. i did not go for pp. i got a RFE from NSC in november and replied within 15 days and they did not update until 26th January as that was the last date USCIS has given the deadline for submission of RFE. i waited for two more months as USCIS informed that it will take 60 days to make a decision on that. assuming 60 days for taking a decision; i need to get a reply by the end of march. still no reply. i asked my attorney and he informed me that he put a query and it will take 60 days to get a reply from them. so i have to wait for 60 more days.

also i am in the 5th year of my h-1b. i hope there is no problem for my position with the present company and my h-1b with the company is getting over by sepetember 2007. my questions are:

1) if i go for pp right now; and assuming that the i-140 will be accepted in the next month what are the consequences if i do not apply for extension of my h-1b with the present company. if any problem with the present company in the next year and i do not get green card by that; without having valid h-1b do I need to back to india?

2) if i do not go for pp and wait for approval of i-140 and i-485 and apply for h-1b extension; and if i do not get my green card by the end of next year (by which time i am going to complete 6th year of h-1b); can i extend the
h-1b beyond sixth year.

friends please answer my questions.
