Good news ! Infact it would expedite the green card process for legal aliens.

Even though it might delay our 140 processing, we might get our 485 approvals very fast!
I would take this as positive news.

I am afraid it will delay processing by 5-6 months as it happened
for Labor certification approval .., it was delayed by six months
because of 245(I) applicants ...

They dont care about benefit section.. INS restructuring in enforcement.. not in benefit section for alien. Even they do change, and when all dust settle down, it will cost you atleast two years for current pending applicant. It will defintely reduce backlogs for future applicant.. not for us.

As far as I know, nobody has any idea of exactly how INS will restructure (including INS officials), let alone how it will affect the GC process.

Your post is pure speculation, without any basis. The bill has not been passed yet, there are no implementing regulations or guidlines, and yet you are stating how it will effect processing of cases?

I believe the speculation is quite reasonable, given that:

There has been no mentioning about current processing during the restructuring in this whole thing, and there has not be any statements about immediate work progressing so far

I don\'t really see the point of this restructuring - while they were busy talking about whose office moves where, the cases must be all lying around on the desks.

INS has published their re-structuring proposal, which includes the following:

1. Establishing a direct chain of command for the Border Patrol that extends from the Chief at Headquarters to agents in the field.

2. Consolidating various Detention functions under headquarters control.

3. Establish the office of Juvenile Affairs that reports directly to the Commissioner.

4. Launching a search for Chief Financial Officer and Chief Information Officer.

5. Establishing a Field Advisory Board to act as a liaison between the Headquarters Office of Restructuring and the various field components.

The bill hasn\'t even cleared the senate yet. The bill just passed the House. It must pass the Senate and be signed by the president before it\'s even definite. AC21 passed a year and a half ago and we still don\'t even have implementing regulations for it. All AC21 did is make some changes in immigration law and procedure, this thing would eliminate INS and break it in 2 parts. It certainly isn\'t going to happen tomorrow.

The has to pass in senate. Web of Law firm Fragomen, Delray, Bernsen and Leowy states that it will take at least
5 months just to effect current processing time even if the bill passes in the senate and signed by the President.

New approval procedure for I140 case?

I just checked IRS AVM last night and heard the following message
“On May 4 we mailed you a notice that we approved your case. We send it to the appellate body for review. The notice explains in detail the basis for such proposed action. If 14 days passed and you have not received the notice, please contact…”

Can anyone tell me whether I am approved or still subject to an “appellate body” review? Is this the new procedure for I140 that Vermont center needs to send case to next level review? What’s that appellate body?

Security Checks:
The VSC indicated that all files must now undergo a security check during a meeting on the 17th of April. As of that date, there were approximately 40,000 cases that required the security clearance before a final decision could be rendered. This will have a substantial impact on adjudication, probably resulting in at least an additional month in sending out approval notices. Requests for evidence (RFEs) will continue to be processed. It is the final adjudication that is being delayed.

Why some approvals could escape from the so-called check?
40,000 is not a big deal when you just check the name on your database.
 
100% lucky - but sure they must have gone through the name check

my case must be so unlucky that it is waiting in the name check line with a bunch of I-130s and 485s in front me :((
