USCIS has just announced that the fiscal year 2005 H-1B cap reached at the end of 10/01/2004, Friday and unless the new cases were received within October 1, 2004, the new petitions which were subject to the cap would be rejected and returned to the petitioners. Accordingly, the petitioners who shipped out the petitions by mail or overnight delivery services on Friday, October 1, 2004 will receive rejection as the petition will not reach the Service Center until October 4, 2004. Postmark is not enough.
Those cases which are subject to the cap will not be available for H-1B until October 1, 2005. Check following link:
