Brand new H1B after 7th year extension.

My 7th year extension is expiring in Oct 2005. I am thinking of going to India in July 2005 and thinking of staying in India for 1 year so that my current employer can file new H1B. My questions is if I have to be out from JULY 2005 to July 2006 or until Oct 2006, to get the brand new H1B visa. My employer has already filed labor cert. but stuck in backlog center. I don't know till when.

I think it will be OCT,2006.Since you will come under Fisical year 2007 Quota
so you can start working from OCT,01,2006 but you can get it stamped before
