Hello friends,

I have a quick question. My fiance has applied for immigration and credential evaluation from India (Type I). However, she will be attending the VISA interview as a F2 dependent. Does anyone have any idea whether it is safe to do that by saying that I have a not applied for immigration in the past ( there is a section in the application form which says that ...have u applied for immigration in the past) ?

Ur time and information will be appreciated.
Thanks,
satya.

Very high chance of rejection.

F2 is a non immigant single intent visa. Chances are very hoigh of rejection if individual has themself applied for immigration. If it was H1 or H4, no problem as that is dual intent visa.

I am not concluding that she will not get it but chances of rejection are significant. Also I would not advice anyone to lie in a visa interview.
Thanks

Hello Texan,
Thanks for the information. Do u think cancelling the immigration process will help?
Please let me know.
What are the likely questions they ask. Do they ask her about her profession?
satya.

By filing immigrant petition, she has already shown intent to Immigrate. Therefore I dont think cancelling immigration petition will help, because the question on form is "Have you ever applied for immigrant visa before" and even if she cancels, the true answer to that q has to be a yes.
I would suggest she seek employment and come on an H1 visa, or wait for you to get H1 and come on a H4.
Of course she can always apply for F2 and see if luck is on her side and somehow it may be her lucky day.
