Boston USCIS - Urgent Help need Please respond

Folks,
I went for interview yesterday and passed out the test. However the Officer wanted more information on one of the traffic citation (Quincy MA) since I appealed for a court hearing. First I appeared before a clerk and he asked me if I would like to pay the fine and I told him Yes and paid it ($100). I did not appear before the judge at all. This happened two and half years back and now the court says they do not have any proof of record.

What shall I do? Please provide your inputs in this regard.

Thanks

hi i had a similar situation too - u have to consider this a a payment of ticket.-
if the court doesnt have it - ask RMV - they should have the ticket info!
and if u have used a creidt card or something u can prove - even otherwise the ticket info should be good enough i guess

i think in my case - i plead "no contest " which means neither guilty nor non-guilty

so what we did -eventhough we technically contested the ticket- is we went to a clerk and the clerk asked what u wanted to do - and we did no contest and paid - just like what we should have done on the back of ticket - ticking no contest and paying - in the first place.

...which for immigration purposes is equivalent to pleading guilty.

Is this your personal opinion or could you point to some links where this can be verified.
I think people plead "no contest" at times to reduce traffic fines and in no way it would mean pleading guilty..

It can be verified if you search around. Here is one such link that I found in just a few seconds using the search terms "nolo immigration law". http://www.vakilikarimi.com/CI.htm

If you need more detailed advice, I recommend finding an attorney.

Folks,

I appreciate your reply. Sorry for my belated response. Here is the status so far. I went to the COurt again yesterday and requested them to help me with the processs. They told me to be in touch with the Merit Rating Board, who may have a copy of it. I have reached out to them and requested to send me all the documents related to that particular citation. These are my following questions to you guys

1. If I submit the complete details from Merit rating Board, will that Satisfy the USCIS people?

2. In the letter he has given to me, he has clearly mentioned that I should produce in "Original all COurt related documents". Shall I take those documents and ask the Clerk's office to validate it?

3. How long it takes for the USCIS to respond once I submit my details? Any experience particularly with the Boston office?

Once again your response is appreciated.
Regards,
Ravi

Traffic violations don't generally impact natz unless they involve alcohol, drugs or fines over $500, so yes, its a moot point.

Luck,

So no decision was made on your case at the time of the interview because of a traffic ticket? What happened to "no documentation required for tickets less than $500" that is stated in N400 instructions as well as document list for interview? I think a lot of IOs don't abide by that. At my interview last year, I was asked to provide documentation for tickets under $500 as well as dismissed tickets. Luckily I had all the documents. I was even interrogated about the circumstances of each ticket. Of course, I was not going to anger the IO by pointing out that his questioning and demand for documentation went against USCIS guidelines.

I guess in order to prove they were under $500, you need some sort of documents stating that they were under $500 and didn't involve DUI or drugs.

I am having some trouble tracking down my old tickets. I received one in baltimore over 6 years ago and I cannot find any record of it. As I understand, traffic tickets are "purged" after 5 years in Baltimore?

I reported all my tickets on the N400, but I am increasingly becoming of the opinion that people should not report tickets that did not involve an arrest, DUI, etc. IOs are not consistent in how they deal with tickets; some tell people they didn't have to report them, some interrogate people over dismissed tickets. It's all just a nuisance. USCIS cannot deny naturalization minor traffic citations, but some mean IOs give people s--- over them just because they can.

Rahim,
Yes.. My case is pending due to the proof of docs on Traffic tickets. It is crazy but cannot blame anyone as I did not carry the proof for my Traffic violation....

What did they wanted? Canceled Check or Offical Court Disposition?

I am getting worried after reading your case. I have some tickets in the past that I cannot track down. No one seem to have any record of it. My driver history is clear and it doesn't show up in the court's website.

I don't even know when and where I got 2 of my speeding tickets. It was middle of nowhere in Pennsylvania.

Supercomp,

Have you already filed your N400 and mentioned those tickets? If not, I seriously doubt you'll have any problems if you don't mention them. Think about it this way, if you are unable to find any documentation about them, do you really think they'll show up in a background check? Plus, it's just not something that can influence their decision anyway...... I know this is a controversial subject and there are many different opinions on this. You should, of course, use your own judgment.

I actually did not put my traffic tickets on my N-400. I misread the N-400 instruction where it says "don't worry about it if its not DUI, Drugs, or over $500". I interpreted that as to ignore minor speeding ticket and don't list them on N-400.

I found this forum after I mailed my N-400. Otherwise, I would probably have listed those tickets.

Anyways, I want to try to get my traffic ticket records in case it comes up during the interview.
