Does anyone have any experience with a situation similar to this? My ex husband who has a greencard, filed for citizenship. After 2 years of waiting, the INS finally replied and said that they had reason to believe there were something like 8 federal offences committed and that he had 30 number of days to prove otherwise. These included fraudulent marriage to get his greencard 12 years prior, not paying his taxes, making another country his residence (for 14 months during the 5 years they look at), not paying child support etc. He was told if he could not disprove these claims that a warrant for his arrest would be issued.
He then filed some form of paperwork, which didn't not even come near to clarifying his situation, which in fact, what they were claiming was true, and he went to his local INS office an they looked up his file. When they opened his file, they said there was a code next to his greencard number meaning that it had been cancelled or revoked, but they did not take his greencard from him.
He then flew overseas for a month, and is due back to the US this week. When he enters the US, and this is still pending, what is likely to happen? Will they let him in or hold him? His attorney had advised him not to leave, and I imagine it would be hard to get out of the claims which would mean he would have to manufacture documentation......so, how is it likely the airport ins will deal with his return if the case is still open?
He is a white english man in his fifties if that has anything to do with their reaction. Is the airport INS linked to the system for greencard and citizenship applications? Would they let him in to sort out his affairs or let him without problem despite the claims?
