Blackmailing an NRI on H1B. Please help!!!

My friend is on H1B visa and been in US for 4 years. He is an NRI (Non-Resident Indian). He has an associate(friend) in India who did business with him before coming to US. The friend of my friend who is in India recently visited US and took some money from my friend on a hope that he will return it. But the situation turned sour now and the friend of my friend is blackmailing him saying he will report to INS about him doing business in US on H1B visa etc...

My questions are:
1. What is the protection for my friend being an NRI?
2. Will my friend\'s friend\'s wrong report to INS cause any damages to my friend?
3. what is the office my friend can report blackmailing?
4. Is it necessary to report the blackmailing?

As I understand, it not wrong for an H1 visa holder to do business. What is wrong is H1 visa holder generating revenue for himself from that business. So, your friends associate\'s simply complaining to INS does not hold ground, unless he has documented proof that your friend had additional source of income from this business.

As for your friend, as a NRI (or H1 visa holder) gives him no protection and, I do not know, of any office where he can complain since he is a temporary immigrant and his associate is in India.

might depend on the kind of "business"

of course the above postings depend upon the kind of business your friend and his cohort were doing. neither person might be interested in FBI or India legal authorities knowing the details...

However, assuming a lawful business situation that would not interfere with a persons' H1 status, it might be in your friend's best interest to seek an attorney for recovery of the money, since the other party has decided not to return the investment and has decided not to provide the service/product. That would be a civil matter for either US or India court and not really for this forum.
