bizarre situation

I have a bizarre situation. my lawyer made a mistake and sent my AP application to the local INS office instead of TSC. when we found out about this he sent a request to the local office for the transfer of the file, and applied for another one at TSC. after 1-2 months I received an AP from MSC. I guess the local office forwarded the case to MSC(NATIONAL BENEFITS CENTER) mistakenly....In this case should I use that AP for my travel. the other AP at TSC is still pending. and it has been more than 90 days. I initiated an inquiry...som my question is: is it safe to use the AP from MSC even though my I-485 is pending at TSC? thanks for the help

regards

AP from uscis

There should not be any problem in travelling on the AP issued from MSC as it is also part of USCIS. Also there should not be any issue travelling on one AP while the other is pending. But remember, you cannot use a AP to enter which approved after your last exit date.

My lawyer says that you can enter with second AP if it was approved out of country and first one has expired. There were references to USCIS memo in murthy.com, but is there any reference for this USCIS or AILA web sites. I do not get this logic at all.
