RFE?
AD?

I have submitted birth certificate issued just before submitting the 485, from Indian Consulte In Chicago. I guess its certian that I will get the RFE for same. Please advice what doucuments (note from parent(s)/relatives, affidavit shall be required, which I would like to get before hand.

Frustrated like anything, doesn't want to wait for RFE to start for arranging for these things.

Any advice appreciated.

Thanks

donot get before in hand anything . wait and see what is iio fools would not .sometimes u might not get an rfe u might get approved.or u might get rfe in someother thing like employ. rfe than ur birth certificate . even it is birth certificate ur father and mother have to go a lawyer and sign before him stating that u r their son born on such and such date. they have to just sign rest would be filled by the lawyer itself. so donot worry wait and see.

ALL THE BEST

Yes, its better to be prepared

Redforgreen, yes you can be prepared. This is what they require. If you dont have a birth certificate, you need 2 affidavits (father and mother) and a Non-Availability certificate. This cert should be from the municipality/corporation of the birth place as in your passport. So all you need is a non avail certificate stating no birth record is available and 2 affidavits (sample formats are available for both and you can search for it in this site).

If you are from India, some govt agencies dont know what is a non availability certificate and are reluctant to give. But it is still worth a try. If you cannot get it, try to apply now and get a birth certificate with all necessary details. I am sure lot of people have done this so that you can be ready if any RFE arises. Even if you get a BC, 2 affidavits is always needed since your BC issued date will be recent.

As Vanakam said, DO NOT SEND ANYTHING unless asked for.Be prepared thats it.

Hope this helps. THIS IS ONLY A SUGGESTION. Always check with your attorney.

Thanks for the info.

1) Regarding Affidavit, has it to be from father and mother both. Can't it be from some other relatives, as I lost my mother recently. Bio-info attached with 485 does not state this situation.

2) Well I have submitted the birth certificate, issued by Indian Consulate in Chicago in Oct 01.

Caveats are a) Issued recently.
b) Issued based on passport.

Not clear to me that in this situation, a non-availability certificate is required.

3) Sure, I am not planning to send any thing in advance, just preparing for RFE. In case RFE is not issued, God is great, otherwise too.

Guys what do you think, please.

Again appreciate any info.

yes u can get affadvit from close relatives like ur uncle (mothers brother or ur fathers brother or sister). One of my friend got aff. from his uncle and his case got approved. it should not be a big problem

Very sorry to hear about your mother. As vanakam said , you can get it from your close relative. The only thing is if a relative gives an affidavit there should be a sentence in the affidavit saying " I know this is true because I was present at the time of the <concerned person's name>'s birth or something like that. Just to say they were present at the time of birth and they know. Check out the sample affidavit for relative or you can get it from your lawyer.
