Birth Certificate RFE by VSC plase help.

Hi ALL,

My case detail EB2/INDIA/RD Apr 02,1999/ND May 03,1999. RFE issued nu VSC om Aug 12,2000.

My lawyer received a RFE from me and my child asking for Birth Certificate and for my wife employment letter. When we applied we submitted non-availability certificate from municipal corporation and affidavits from parents and uncles.

SO mow the question is what kind of birth certificate they want.

Any one in same situation or having experience ? pleas reply.

Why INS need employment letter from my wife ( she is dependent on my case)

Any ideas...

What do you mean ? my lawyer did all of those things. Do you man that something is messed up there
and INS is considering her as primary applicant ?

Can you tell me how you response to INS?
I am worrying about my parent\'s DOB as well. I just submitted to INS, but not sure they will come back and ask some proof of my parent\'s DOB. My parent\'s didn\'t have birth cert. as well.

Hi DG,
The INS even accept a birth certificate issued by the Indian Consulate-at least they did in my case so you may want to consider this option.

When u say INS accepted a consulate BC, do u mean that ur 485 has been approved based on that? Please clarify as it will be useful for many of us..

I submitted a bc that had been issued by the Indian Consulate with my I485 as I did not have the original bc from the the municipal corporation at the time, like so many others on this board. However, in the RFE (refer to my earlier postings), INS did not request for the original bc so I assume that they accepted the document issued by the Indian Consulate. Following the RFE response my application has been appproved and passport was stamped on 8/13/00 (Boston office).

Hi,

I recd an RFE for birth certificate since the one I got from Collector\'s office did not meet INS specifications. I had to get 2 \'affidavits\' from my relatives (can be parents) certifying my place and birth with notarization from a notary public.

I have the sample affidavits that I cand send to you in an email. If interested, let me know your email.

Thank you VSC121 99 and RAV. I have submitted my 485 with the consulate certificate in Oct 99. I als have the affidavits signed by my parents and relative with me in case I recieve an RFE. I\'m also trying to get a certificate from the muncipality where I was born that my birth was not registered but have not yet succeeded. But VSC 121 99s case gives me some confidence now. Thanks again !!

What is the format of the same ?

What is procedure to get birth certificate from INDIAN COUNSULATE ?

Hi DG,
I am trying to recollect as best I can as I got the bc from the consulate 3 years ago. I got the certificate issued by the NY consulate. IF I can recollect correctly there is a form that has to be filled- you can get the form by calling them and they will mail it to you and then you will have to mail (Fedex) your passport along with the form as the consulate will only consider the date of birth entered in your passport -there was also a nominal fee involved. If you call them they will tell you exactly what to do. The turn around was pretty quick- something like 10 working days. I am sure every Indian consulate will have the same format so it does not have to be the one in NY. The certificate essentially says that your date of birth according to your passport is such and such. If you are interested I can pull out my bc and post the exact wordings. Sorry to sound a bit vague as its been a long time. Hope this helps.

I think you can get the form on the Indian consulate website too. Try doing a search. In my case I called the Indian Consulate in NYC and they sent me the form. I filled up the form and went to the consulate and they issued the certificate on the same day. I think I paid $25..not sure though. You have to take your passport with you.

Hi DG,

Do you remember whether your birth certificate and affidavit have the same details and this should also correspond to the Geograhic Form filled during 485.
