Birth certificate requirement for applying under EB-1category

Hi all,
I am starting my green card application under the EB-1 category. The law firm I am dealing with requires that I submit my birth certificate at the time of application. The problem is that I was born in ramgarh which was in Bihar but is now in the state of Jharkhand and because we have no relatives there it is difficult to procure a NABC. i have sworn affidavits from my parents and asked Your Man in India to help me get the NABC.
My question is: Can I send my application without the NABC with only the affidavits & my school certificate and submit the NABC at a later date.
Additionally if anyone knows of alternatives to the NABC, your input will be very helpful.

Goahead and file your petition. U will get RFE. At that time u can submit NABC. Any how I-140 processing itself takes about 3-6 months and it depends upon the center which adjudicate your case. within this period try to get NABC.

I am also in the same boat. YourmaninIndia is getting my NABC done and in the meanwhile I have filed my I-485 already. I have sent three affidavits with three different school birth certificates (High School, Junior college and Professional College). Like someone said until you get that RFE its gonna be atleast 4-6 mo and till that time hopefull YMI comes thorugh for us....:-))

My lawyer adviced me to fix the Birth Certificate before filing 485. He felt, RFE can introduce avoidable delays. Also, he felt, because of BC, they may start checking all documents with more seriousness.

So, we delayed the whole thing by about 3 weeks. What worked for me is that, I could get a brand new Birth Certificate issued in 3 weeks after greasing some palms in India. However, i did not have issues like a new state being created which adds its own complexity.
 
you can get a birth certificate from the Indian consulate by sending your passport and applicable fee.
 
I had read on this post that works only 50% of the times....because that certificate is based on your passport which the USCIS already has by the way. So I think the embassy BC is to be sent with cautiousness. Thought many people have gotten by with that....but just to stress that is not what thy want.
 
You can submit these documents from consulate if time is an issue and prepare ur self for possible RFE (if any) by getting Non avaliability and family affidavits.

PS: may I suggest reader not to post any idea encouraging corruption "like greasing hands"
 
Kudos Eb1doc ......I think that is true.....besides I am sure the USCIS browses sites like this and even though we know the general view about India and getting documents is evident to most lets refrain from using these words so losely. There are still some people who gets things done in a right way.....peace all.
