New Birth Certificate Question...pls Help..... :confused:


Hi,

My attorney asked me to get a new Birth Certificate now. Is that valid enough for the Birth Verification. Do I need to support with any other Docs. ?

Will INS accept the new Birth Certficate (ie., issued after almost 29 years of your birth ) ? DO they ask any other Docs. Pls clarify.

Hi Medan,

a) If your birth registered in govt.office, then try to get get new birth certificate with contents " ......... as per our office records of 19YY-YY. ..............."

(19YY is your birth year)

b) If your birth not registered in any govt.office, then get a non availability certificate from govt.office and additionally submit two affidivates from your parents/relatives.

Also submit school certificate.

I have one important query related to this...

Will INS accept New birth certificate received somewhere in this year 2006(ie... almost 30 years from my date of birth)...if they accept will they ask for any addtl. docs.....pls clarify

I don't understood why so much confused on this issue. Please see my previous reply, it was clear enough.

Anyhow, see the following:

i) First of all, you already had birth certificate, so you can submit that certificate to INS. No need to get new one.

OR

ii) If you already had birth certificate, still you want to submit certificate issued in this year, so you can request copy of the birth certifcate from office where certificate was issued before.

I mean, If your birth was already registered, so you ask copy of the cerficate at any time evern though after 30 years of your birth.

(Example: If you completed your graduation in 1993, still you can get your degree certificate today. In this scenario, on your certificate issue date will be May 23, 2006. But your completion of degree will be 1993.)

See my reply under option A, It was clear. If your birth year is 1976, then you need to get birth certificate saying that your date of birth was MM-DD-1976 as per birth records of 1976-77. It's oK to have date of issue is some time in 2006.

Additionally you can submit affidivates from your parent/relatives. Also submit school certificate showing your DOB.

Note: YES, INS will accept birth certificate issued on this year.

OR

iii) If yor never had birth certificate and your birth never registered after your birth. In this scenario, getting new birth certificate is not possible. So, please follow option B in my previous reply.

Single affidavit or separate affidavits

Hi,
I don't have D.O.B certificate but I do have a single affidavit from my parents. Do I require a single affidavit of two separate ones?

A help will be great.

My birth year is 1974 but My parent registered my birth in the year 2004 in Government office(Muncipal corporation). Birth certificate issued by govenement office says birth date registration as 2004. Do I have to submit any additional evidance to avoid Birth Certificate RFE at 485 stage because it was registered in 2004 rather then 1974 in government office?

Did you get any RFE for 140. Mine also EB2 labor substitute. what are the possible RFE's in 140 stage.

Affidavit from your parents or some elderly can avoid RFE.
I would send affidavit only upon RFE. Sometimes too much documentation is bad.

If your birth registered in yr 2004 and issued says as per registration records of 2004. It's fine. But in general we should register birth within year.

In your case, It's also better to submit affidavit as additional documents from your parents/relatives saying that your DOB is MM/DD/1974 and registered in Govt records in 2004. Also submit your school certficate.

(USCIS looks Birth Certificate mainly to see your country citizenship and also to allocate visa number under EB category of your country. Insufficient documents leads to RFE)

Hi WW_S1974,

If you don't have DOB Certifcate, then first of all you should get
non-availability certificate from your place of birth. Affidivit from parents is an additonal document in your case. Single affidivit from parents is enough.

Also submit school certificate.

No RFE's straight approvals. Mainly we get Ability to pay, Education and Experience RFE at 140 stage.

When you go for substitute Labor, are you supposed to be working in USA from the date of Labor application.

I got a substituted labor & the PD is Feb 2004. But I was working in USA during 2001 -2002 & went back to India. I was working in India during 2003-2004 & came back to USA on 2005.

So I was not working in USA during 2004. Will that be a problem, since I dont have w2 for 2003, 2004. Am i supposed to have w2 from 2004, as per law. My labor was substituted this year, 2006.

PLs give me your valuable thoughts/suggestions. if there is a problem, how could i tackle this.

pls help me on this...

I don't see any issue as long as your company can prove ability to pay since labor PD. There are various way to over come ability to pay issue. Search for ability to pay thread you will find many post regarding how to over come ability to pay. To get the best advice, read Unitednations posts he has wrote and solved almost every issue.
