Birth Certificate Question (Please Help)

Hi everybody. I have a typical situation. At the time of filing 485 I didn\'t have Birth Certificate. So I filed with 2 affidavits and SSC certificate. Affidavits state that my Birth is not registered at the time of my birth and vouch for the Date Of Birth details.

AFter filing for 485 my father tried for Non-Availability. But the municipal guys told my father they can\'t issue a non-availability, since my DOB is after 1970. They said they can instead register the Birth and issue a BC based on a sworn affidavit before magistrate by my father. So my father got issued a Birth Certificate for me.

If INS issues an RFE for Non-Availability, can I submit the Birth Certificate explaining the reason? The date of registration in the Birth Certificate is the date when they actually issued the BC i.e. last year.

Any opinions / suggestions are extremely welcome.

I don\'t think it\'s a problem.....

when they issue RFE you can submit the BC that you have got now......

also check with your lawyer for the best way out.....

I dont think you are going to have any probel as you have submitted affidavit. My situation was quite similr to yours. I didn\'t have birth certificate and tried to get non-availabilty from municipal corporation and they denied (even my DOB was prior to 1970). They suggested to apply for birth certiciate. I had to pay huge penalty. Any way to cut this long story short, I submitted the BC that I got recently. I was excepting RFE as I saw many posting at CSC sites having RFE for such cases. I was lucky enough that I did not get any RFE and my case was approved on April 1st. So you are OK and even inthe worst case if you get RFE you have BC with you that will suffice the INS reuirement
