Birth Certificate (Last Name is Now Different)

Thank you for all your help here is one more question.

The Birth Certificate my wife has is under her Mother's Maiden Name because her parents were not married yet. After their marriage my wife took her fathers last name and because she was a young child they did not go through the court process to change it. Will this cause any type of problems when submiting the I485 Packet? What should we include to help describe the situation?
 
In my opinion, it doesnt really matter and the certificate is fine for you to use.
What matters is making sure that the same name is used in all documents so it is consistent and does not cause confusion.

Well this is the only time that name appears, in all other documents School Records/Drivers License/ Passport the name is her father's last name. The Birth Certificate is the only document that show's her mothers last name.

In Germany they do not list the father on the BC like the do in the US.
 
In one of the applications she must put "ALL" the names that she has been used, in those lines she must put the names.

In other countries the BC includes the parent's names even they are not married.

Apparently in some places in Germany you can obtain the different type of birth certificate:

Geburtsschein (minimum details)
Geburtsurkunde (most details)
Abstammungsurkunde (most details - including natural parents)

This is a very good question and I have a similar question from my friend.

She goes by her former husband last name and her Birth certificate still show her maiden name.

She does not want to change her name for now because of the process involved. (her cerificates, passports, i-94 & all other importand documents all bears the name of her formal husband)

Do you think this might affect her in any way.

She has already submitted her application last month.

She suppose to include her divorce decree that will show the last name of her previous husband.

Re Birth certificate

I have the same issue with the different Last name on my birth certificate all My legal Documents are in My Fathers Last name except for my Birth certificate which is in my mom's last name I sent out my application in january with affidavits with my Fathers last name which is the only name i've ever used now I get an RFE for birthcertificate and dont know what to do Because I to dont want to Produce a birthcertificate with another name as if I was trying to be someone else. By the way my Father is decease so I cant get an affidavit from him, Please tell me what can I do
 
This is what I am concerned about as well, her parents are both still alive and it may be possible to get an affidavit from them stating they are her birth parents and that she was born under this name, but after their marriage assumed her father's name. I also have a copy of their marriage certifcate showing the father's name.

One question that I have is if I am sent an RFE will she still receive the EAD? I do not want her to lose her employment over this.
 
Update to my previous post, after spending 1 hour on the phone with USCIS customer service I finally reached someone.

Copy of Birth Certificate
Copy of Marriage Certificate - Parents Marriage Certificate that states the new last name of her mother would be her father's last name.
Notorized Letter explaining the situation.

Hopefully this will work?? Comments other ideas?

Uhmm I would add the Affidavit from her parents, because there is no other document here that shows from where her last name come from. That is my personal opinion.

Bahamas, what type of affidavits you sent? from your parents stating the names? and with all that you received a RFE?

my mother and my mothers Brother made the affidavits had them notarize.here is Basical what it said, I ____________mothers Name ot the settelement of_______town's name in the Island of______ one of the Islands of the commonwealth of the Bahamas make oath and say as follows:

1 That I am ____ years old
2 That I am the mother of a male child born to me on the ___ day of_____--A.D 19__ at the Princess Margaret Hospital Situate on the Island of _________ another Island of the Commonwealth of the Bahamas.
3 That the said child was Named and called ________- _________fathers Last name.
4 that I have made a search at the registara General's office and found no record of such birth.
5 That I make this Affidavit to establish the birth and name of the Said ________ _________
6 That the contents herein are true and correct.
 
But you send the copy of your birth certificate anyway? or you just send the affidavit? sorry but I got a little confuse...
 
This is what we have decided to do. We have her birth certificate with her mother's maiden name. We also have a copy of her parent's marriage certificate that states that the new family name will be the man's. At the time my wife took the last name of her father because her mother was as well.

We are going to write a letter stating this with translated copies of both certficates. Do you believe this will be enough?
 
I have a question regarding submitting Birth Certificate for 485. I currently have only a photocopy of it. Does it suffice or do I need the original to submit to INS? Please advise.
