Birth certificate issue - Please Help!

Hi,

My wife and myself are on H-1s and my wife has decided to file her Green Card (thro Delaware / Tennessee).

She was born as an Indian but her dad expired early and her mother remarried and she was adopted. Now, her name on her birth certifcate refers to her original paternal name which was changed after adoption. Since, this was early in her childhood, all her school certifcates and degrees, passport, etc are based on her adopted name.

We are confused as to what the INS will accept as the stage of i-485? If we submit her birth certifcate and adoption papers will that be all or would there be more for us to do?

You might want to consult a lawyer there, but I would think that a BC and adoption papers that clearly state that the name has been changed should be sufficient.
Don't worry much - worst case scenario you will get an RFE

Alternatively..

..u can "collaborate" with the officer in India giving the Birth Certificate and he would write both her names on the BC ("XYZ also known as ABC"). Also include:

1. official name change papers
2. Two affidavits from closest living relatives mentioning her both names, DOB, Place of Birth, Name of parents. (even though this is not required with BC, some lawyers say it is advisable to attach the same)

What atlantabhopali suggests sounds logical. Document in such a way that all the facts are shown on the documents.

This kind of situation is very well understood by INS and they may not look at it as a mojor issue.
