Hello All,
My kid was born in India and came to US on GC basis at 11 months. Now he is at 2 + years. Planning to send him around 6 months but less than 1 year.
I have couple of doubts, can you please look into this.
1. If my kid stays less than a year in India, do he really have a re-entry permit to come back to USA?. I know the air lines or travel agencies always insist to show re-entry permit if the person stays more than 6 months.
2. For safe side If I apply re-entry permit, I-131 form showing bionmetrics are required for the ages inbetween 14-79 as below. My kid is 2+ years, I think he may not require. In this case I have to send only the application fees $305 but not for biometrics. Please confirm if anybody crossed thru this procedure.
3. Biometric Services Requirement
If you are between age 14 through 79 and you are applying for a Refugee Travel Document or Re-entry Permit, you must be fingerprinted as part of USCIS biometric services requirements. After you have filed this application, USCIS will notify you in writing of the time and location where you must go to be fingerprinted. If necessary, USCIS may also take your photograph and signature. Failure to appear to be fingerprinted or for other biometric services may result in a denial of your application. All applicants for Re-entry Permit and/or Refugee Travel Documents between the ages of 14 through 79 are required to pay the additional $80 biometric fee. (See "What is the Filing Fee" on page eight).
3. In future If we (parents) apply for Naturalisation, will my kid atomatically gets Citizenship once parents gets. Or he need to complete the around 5 years duration and can only apply.
4. If my kid is away for an year out from USA(so far he stayed 16 months in USA), the duration of full 5 years starts again after he returns after a year. or his 16 months stay also includes with part of 5 years.
Thank you in advance.
