Biometrics for green card renewal question

Hi,

This is the background :
1). We have an approved N-470
2). We have been travelling to the US once every year and made sure never stayed away for more than 365 days.
3). Our next visit to the US is in April 2014 (since we were in the US in April 2013)
4). Our 10yr GC is expiring on 11/30/2014.

We know that we can apply for GC renewal any time between 05/30/2014 and 11/30/2014 and also, we must get the bio metrics done during the renewal process. Our question is :

1). Is there a way we can apply and get our bio metrics done during our visit in April and then later apply for renewal on 06/01/2014? Or should the bio metrics be done only after applying for GC renewal?

2). If bio metrics should follow the GC renewal application, generally how long does it take to receive the bio metrics notice, after we apply for GC renewal? This info will help us to plan our 2nd trip to the US in 2014.

You can only get the biometrics done for renewal after submitting the renewal application.

Note that if you have a reentry permit with a later expiration date than your 10 year GC, you can use the permit to reenter the US if the GC expires or gets lost/stolen (of course, assuming that you return to the US before the permit itself expires).

So if you don't already have a reentry permit, you could apply for it when you're in the US (you must be in the US when submitting it, including when USCIS receives it), get the biometrics done for the reentry permit, then leave the US and wait for the permit to be issued.

But note that if you've been outside the US for a total of more than 4 years out of the past 5 years, the reentry permit will be valid for only one year instead of the usual 2 years, or it possibly won't be approved at all.
 
Thank you very much Jackolantern. We have finished the 2 each of 2 REPs till now (before we received the approval for N-470). So, we have not applied and do not have a valid REP now. Since we have approved N-470, we have been travelling back and forth < 365 days.

2 more follow up questions for you please:

1). Please confirm that we can apply for renewal from outside of the US.
2). Generally, how long does it take to get the bio metrics notice after we apply for renewal? i.e., if we apply in Aug, by when do we get the bio metrics notice. This information is important so that we can plan the application time to suit our kid's exam schedules.

Yes, you can submit the renewal application from outside the US. There is no requirement to be in the US when submitting the I-90; the only time you have to be in the US for the renewal process is for biometrics (unless there are special complications with your case, but it is rare to have to show up for anything after biometrics).

Don't send it from abroad using the mail, unless you're in Canada. Send it via private courier such as Fedex/UPS/DHL, or have somebody carry it to the US and mail it.

The biometrics notice normally arrives about 2-3 weeks after USCIS receives the application, with the appointment itself being another 1 or 2 weeks after that. But once you have the notice in your hand you can go for a walk-in before the appointment date.

Need help with understanding N-470 eligibility and documents that one should ask from an employer

Got GC in Oct 2011 (EB1-3 Multinational Magr) still working for the same employer. Now due to my elderly parents need, I requested my employer to transfer me back to abroad(my previous country). I am planning to apply and get a reentry permit before travel. Also I was looking for form N-470 & instructions and got few questions.

Note: My employer will come under “American firm or corporation that is engaging in development of foreign trade and commerce”, And I have stayed continuously 1 Year after getting my GC without any break.

1. Since my out of country job transfer is based on my personal request, am I eligible for applying form N-470?
2. My employer will provide a transfer letter, but it won't have any specific duration or the word "temporary" about this transfer. But the letter will have the annual salary with breakup details and abroad address. Will that be ok for supporting my case?
3. Though I have very less hope on my employer that it might support by providing any other legal docs, it would be helpful for me to know about what docs I should ask in beforehand.

I would appreciate for any other points/clarity if you can provided that am missing here.

Ours was a similar case as yours. We went with an immigration attorney, to file N-470. Although it took a while to get approved, finally it did go through. Unless you have enough experience with filing different cases with USCIS and are confident of doing it yourself, my suggestion would be to go through an attorney. - my 2 cents.
 
Thanks much usadesi and appreciate your prompt reply. Your reply gives me a great positive energy to plan for my travel. I was worried how and where to start this when i realized my presence is needed back at my parents place before completing naturalization process.

My company has a dedicated immigration team with full time attorney to handle all their employees immigration needs. So all these days have prepared my immigration docs all by myself and send it to them to verify and apply. Now also for re-entry they had mentioned they can guide me for filing it.

But for this N-470 they had informed me to seek an attorney on my own and look out on my company's website for all the relevant details for this N-470. So was little worried about what kind of documents/details are required to verify whether my employer is eligible for this category and how to produce those details.

My company is NASDAQ listed and I can find my company's Form 10-K(Annual Financial Report) published in the website as PDF document. Would that be sufficient to verify the eligibility or not? Or what else to required? Please suggest.

I am planning to apply this N-470 form through attorney and have no idea about using any attorneys here in USA. So is it possible for you to provide your attorney's details?
