Big Mistake Done By Nsc!!!!

These NSC idiots made a big mitsake in my AOS application! I would have never found this out if I had not contacted the Senators office for intervention.

NSC put me in the wrong category, i.e., instead of EB1 (outstanding Professor/Researcher) these idiots put me in EB2 category! Can you belive that? In their response to the Senators office they wrote that the PD is Nov 99 for India and mine is May 2003, so telling me to wait for few more years.

I am absolutely devastated, angry, and furious at the kind of unprofessional service, instead of calling it a service center they should be called DISservice centers!

I wonder if anyone has experienced something similar with their cases.

If this response is only basis for your conclusion i will suggest you to reconfirm it by some other means also. I have seen many getting unacceptable response to senator's based INS enqiry. It gives me impression that just to respond to senator they come up with any response at times.

However, everything else the Senators office told me is correct, i.e., my Biometrics are in their file, my FP expired which was done in July 2004, and they will be sending me new FP notices once they find the appointment date etc. Whereas, they specifically mentioned in their response to the senators office that for this EB (2) category the PD is Nov 99, which I know is for EB2; and obvisouly I am placed in the wrong category.
 
Check your 140 receipt/approval notice - you should have your category spelt out in that.

Also before blaming NSC, take a look at the paperwork that your attorney filed - there have been many cases where the mistake was made by the attorney !

My I-140 approval notice CLEARLY states the EB category which is Outstanding Prof/Res., i.e., EB1. Plus there is no attrorney involved in this, I did everything myself. The I-797 was attched to the AOS petition. Do you think I wouldn't check these things?

You are talking about attitude - first look at the tone of your second sentence (of your first post)! Before I post my problem details I know PRECISELY what I am talking about, I didn't blame NSC for no reason. All I asked was, has anyone experienced something similar. If this is going to be the kind of your tone; Thanks but I dont need YOUR reply. Others can reply if they want.
 
I just want to say, to people who are considerably new here in this forum like I am, we should all appreciate members like max2k1 and their good hearts. They are here to help people, answering questiones, giving suggestiones. Think twice before you raise temper towards others, including NSC.

That's right. SHAMAL does not sound like EB1 (professor), he sounds like EB4 if you know what I mean... NSC could think the same :)

Just joking... :) This is not the place to get angry. This is the place to get advices and knowledge.

If I-140 states EB1 - it is EB1. Try calling NSC and sort this out by speaking with any immigration officer.
