Between AOS and Work Authorization

Hi guys,

I'm getting married in 3 weeks (excited!) and will be adjusting status from J1 (not subject to 2 year home residency).

After paying for the fees for the documents I'm a little concerned with the wait times to get temporary work authorization, people saying 2-3 months. I can't really afford to not work for that amount of time, is there anything I can do?

My I-94 says D/S- Duration of Status and doesn't have a set date on there. My J-1 visa expires September 30th. With 30th of October my supposed time to leave the country.

Please let me know if there's anyway I can work between my visa finishing and receiving work authorization.

thanks all- hop you have a great labor day weekend.

James

If you're Canadian and qualify for TN status, you could leave the US and immediately be granted TN status at the port of entry.

If you qualify for H1B and have a willing employer who isn't subject to the annual quota, they could file the H1B with premium processing.

I can't think of anything else that's going to let you work legally in the US between your J1 expiration and employment authorization approval, other than speculative scenarios for which you haven't provided any information to indicate that you qualify (e.g. claiming US citizenship based on having a US citizen parent).

Thanks Jack.

No I'm British and have no US parents. I do not qualify for an H1B visa as i do not have the relevant skills.

So it's no work for 2-3 months? Would the D/S on my J1 not affect the outcome? As my status will technically no longer be J-1 and my status will instead be... pending? I'm not sure.

Perhaps I should take up a couple of new hobbies for October/November...
